This policy explains how AUD Finance collects, holds, uses and discloses personal information across this website, its digital assistant, enquiry forms and Partner Network.
1. Who we are and when this policy applies
Prospect Invest Pty Ltd atf The Prospect Trust trading as AUD Finance Advisor (ABN 23 527 993 752, Credit Representative 410281) is authorised under Australian Credit Licence 389328. In this policy, “AUD Finance”, “we” and “us” refer to that business. We aim to handle personal information consistently with the Privacy Act 1988 (Cth), the Australian Privacy Principles where they apply, and applicable credit, licensing and recordkeeping obligations. This website policy should be read with any formal privacy consent, Credit Guide or privacy policy provided when credit assistance or an application begins.
2. Information we may collect
Depending on how you use the service, we may collect your name, email, mobile, callback preference, residency or visa position, employment and income details, savings, expenses, debts, loan balance and limit, interest rate, property or security address and value, purchase plans, referral source, consent records and correspondence. For partners, we may also collect professional or business details, ABN, GST status, agreement records and payout bank details. Technical records may include authentication details, device or browser information, security logs, push-notification subscription data, language preference and referral attribution. We do not intentionally request identity-document numbers, passwords, bank logins or TFNs in the initial website enquiry.
3. How we collect it
We usually collect information directly from you through an enquiry, the digital assistant, email, a conversation, the partner portal or documents you later provide through an approved channel. We may also receive basic contact and referral details from a partner who confirms they have your permission, from our licensee or aggregator, from a lender or service provider involved in your matter, or from public sources where lawful. If someone helps type a form, you must review and confirm the answers as your own.
4. Why we collect, hold and use it
We use personal information to respond to an enquiry; understand and verify your circumstances; arrange a human review; provide or prepare credit assistance where you choose to proceed; communicate with you; administer referrals, consent and eligible rewards; maintain security and records; manage complaints; meet legal and licensing obligations; and improve the service. If required information is not provided, we may be unable to respond, assess the enquiry, prepare a referral or provide credit assistance. We do not sell personal information. We do not use website enquiry data to train a public generative-AI model.
5. Digital assistant and automated triage
The current digital assistant uses controlled automated rules to provide limited general information, structure facts you enter and create an internal follow-up label. General questions and draft answers remain in your browser session unless you submit a structured snapshot. The assistant does not access a credit report, select a lender, calculate a verified borrowing capacity, make an eligibility or approval decision, or replace Ferdi’s review. The internal label may consider timing and rough financial figures only to organise follow-up; Ferdi reviews every submitted enquiry and may disregard or change it. The assistant’s content may be incomplete, inaccurate or out of date and must not be relied on as personalised advice.
6. Who we may disclose information to
Where reasonably necessary and permitted, information may be disclosed to our Australian credit licensee, aggregator and their compliance providers; lenders, mortgage insurers, valuers, credit reporting bodies and application-service providers when you choose to proceed and the required consent has been obtained; professional advisers or contractors assisting your matter; IT, hosting, authentication, database, email-notification, push-notification and security providers; regulators, courts, dispute-resolution bodies or law-enforcement agencies where required; and a buyer or successor if the business is restructured. A referral partner receives only limited progress and reward status where the client has consented, not salary, loan balance, lender, security address, documents, recommendations or decline reasons through the partner dashboard. The initial website form does not itself authorise a lender credit enquiry; further consent and verification are required before an application proceeds.
7. Website providers and overseas processing
This service uses third-party infrastructure for hosting, authentication, database storage, email alerts, push notifications and address suggestions. Partner login account and session records, a hashed one-time-code verification record and security rate-limit data are stored in the website database. Resend receives the partner’s email address and one-time code solely to deliver the login email; the code expires after five minutes and is consumed after successful use. When address suggestions are used, the text typed is sent to Photon/OpenStreetMap; you may enter an address manually instead. Google Maps receives a query only if you choose its external map link. Some providers or their support systems may process or store data outside Australia. Their locations and subprocessors may change and may not always be practicable for us to specify in advance. Before submitting, contact us if you require current information about a particular provider or likely location. We take reasonable steps appropriate to the circumstances when selecting and using providers, but overseas recipients may be subject to different laws.
8. Cookies and local device storage
The website uses essential or functional cookies and local storage for language preference, referral attribution, dismissing a prompt, authentication and security. The current website does not use behavioural advertising pixels. If analytics or non-essential tracking is added later, this policy and any required consent mechanism will be updated.
9. Security, retention and data breaches
We use access controls, authenticated broker and partner areas, limited partner views and other reasonable technical and organisational safeguards. No internet transmission or storage system can be guaranteed completely secure. Information is retained only for as long as reasonably needed for the purpose collected, legal or licensing records, dispute management and legitimate business administration, then destroyed or de-identified where lawful and practicable. If an eligible data breach is suspected, we will assess and respond in accordance with applicable law, including the Notifiable Data Breaches scheme where it applies.
10. Direct marketing
We may send service communications about an enquiry or relationship. Marketing communications are sent only with consent or where otherwise permitted by law, and you may opt out at any time by using the unsubscribe method provided or emailing us. Opting out of marketing does not prevent necessary service, compliance or transaction messages.
11. Access, correction and privacy complaints
You may ask for access to or correction of personal information we hold, withdraw an optional consent, or make a privacy complaint by emailing ferdi@audfinance.com.au with “Privacy” in the subject. Please explain the request and provide enough information for us to verify your identity without sending unnecessary identity documents. We will acknowledge and investigate a complaint and aim to respond within a reasonable period. If you are not satisfied, you may contact the Office of the Australian Information Commissioner. 12. Children, external sites and changes
The enquiry service is intended for adults and is not designed to collect information from children. External websites have their own terms and privacy practices. We may update this policy when laws, providers or service features change; the current version and date will appear here.
